These Terms of Use ("Terms") govern your access to and use of our social media platform, services, website, and mobile application (collectively referred to as “Vaibino”, “we”, “us”, or “our”). By creating an account, accessing, or using any part of Vaibino, you agree to be legally bound by these Terms.

By submitting User Content on Vaibino, you agree that:

• You own or have legal rights to the content you post.

• Your content does not infringe upon any copyright, trademark, privacy, or other legal rights.

• Your content complies with our Community Guidelines and does not promote hate, violence, abuse, or illegal activity.

• You grant Vaibino a non-exclusive, royalty-free, worldwide, transferable license to use, host, reproduce, distribute, display, and share your content for the purpose of operating, promoting, and improving the service.

You retain ownership of your content, and we will not sell your personal data or content.

4. Prohibited Activities

You agree not to use Vaibino to:

• Violate any laws or regulations.

• Post illegal, offensive, abusive, or harmful content.

• Harass, bully, or threaten others.

• Promote discrimination, hate, or violence.

• Impersonate another person or misrepresent your identity.

• Use automated tools (bots, scrapers, etc.) without authorization.

• Interfere with or disrupt the functionality or security of Vaibino.

• Upload malware, spyware, or viruses.

Violations may result in content removal, account suspension, or termination without prior notice.

5. Community Guidelines

Vaibino fosters an inclusive, respectful, and safe community. You are expected to engage with others civilly and respectfully. Offensive, harmful, or disruptive behavior is not tolerated. Users who repeatedly violate these values may be removed from the platform.

6. Intellectual Property

All content, software, design, branding, and functionality of Vaibino (excluding user-generated content) are the intellectual property of Vaibino and its licensors.

You may not:

• Copy, modify, distribute, or sell any part of Vaibino’s platform or branding without our express permission.

• Use our trademarks, logos, or brand identity in any way that misleads or confuses others.

7. Privacy

Vaibino is committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and safeguard your data. By using Vaibino, you agree to the collection and use of information as described in that policy.

8. Termination

We may suspend or permanently terminate your access to Vaibino at our discretion if:

• You breach these Terms or our Community Guidelines.

• Your behavior poses risk to other users, our platform, or legal obligations.

• We are legally required to do so.

You may delete your account at any time in your profile settings. Termination will not affect any rights or obligations accrued before termination.

9. Disclaimers

Vaibino is provided “as is” and “as available.” We make no guarantees regarding:

• Platform uptime or uninterrupted access.

• The accuracy or reliability of user-generated content.

• The outcome of using our platform or services.

Use of Vaibino is at your own risk. We are not liable for the actions, posts, or behavior of other users.

10. Limitation of Liability

To the maximum extent permitted by law, Vaibino, its officers, directors, employees, and partners shall not be liable for:

• Any indirect, incidental, special, or consequential damages.

• Loss of data, profits, revenue, or reputation.

• Any issues arising from your access to or use of Vaibino.

Our total liability shall not exceed the amount you have paid us, if any, in the past 12 months.

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles. Any legal disputes arising from your use of Vaibino shall be settled in the courts of Nairobi, Kenya.
